This Privacy Policy explains how AcerLogic Educational Services, LLC ("AcerLogic," "we," "us") handles information in connection with The Construct application (the "App") and the website at theconstructapp.com (the "Site"). It is part of, and incorporated into, our Terms of Service.
The Construct is local-first and bring-your-own-key. Your projects, conversations, files, and AI credentials live on your own Mac. We generally do not receive your content. A few specific things leave your device, described below, and we tell you what and when. We do not bundle analytics or tracking SDKs in the App, and we do not sell your personal information.
The App stores the following locally on your Mac, in your user folders, and AcerLogic does not collect or have access to it:

Because our analytics is cookieless and the Site does not set advertising cookies, the Site does not present a cookie-consent banner; the third parties above are disclosed here instead.
We use the limited information we receive to: provide and maintain the App and Site; deliver updates; process and support purchases; respond to your requests; protect against fraud, abuse, and security issues; and comply with law. We do not use your content to train models, and we do not sell or rent personal information.
We share information only as described here: with service providers that help us operate, under terms limiting their use, including Stripe (payment processing), our website host (static hosting and server logs), Plausible (cookieless website analytics), Google Fonts and a CDN (serving website assets), and Buttondown (email signups); to comply with law or valid legal process; to protect rights, safety, and security; and in connection with a business transfer (merger, acquisition, or sale of assets), in which case we will seek to ensure the recipient honors this Policy. We do not control, and are not responsible for, the privacy practices of AI Providers or other third-party services you connect.
We design the App to keep your data on your device and to encrypt your AI credentials at rest. No method of storage or transmission is perfectly secure, and you are responsible for securing your own device, accounts, and credentials.
Your local data persists on your Mac until you delete it. Because it is local, you control retention: you can delete projects in the App, and you can remove the App's data folders. The App's "export your data" feature reports where your data lives so you can copy or delete it. We retain the limited records we hold (such as purchase records and support correspondence) as needed for the purposes above and as required by law.
Depending on where you live, you may have rights to access, correct, delete, or port personal information, to opt out of certain processing, and to be free from discrimination for exercising these rights. Because most of your information is local and within your control, many of these rights you can exercise yourself directly in the App. For information we hold, contact info@theconstructapp.com and we will respond as required by law. We do not sell or "share" personal information for cross-context behavioral advertising as those terms are used under California law.
California (CCPA/CPRA). California residents have the rights described above. The categories of personal information we may receive are identifiers (such as email) and commercial information (such as a purchase record). We do not sell or share personal information.
EEA/UK (GDPR/UK GDPR). The App is offered from the United States and is intended for U.S. users. Where the GDPR or UK GDPR nonetheless applies to you, our legal bases are performance of a contract (providing the App and processing purchases), legitimate interests (security and product operation), and consent (where required, such as for optional features). You have rights of access, rectification, erasure, restriction, portability, and objection, and may lodge a complaint with your supervisory authority. Contact info@theconstructapp.com.
The App is not directed to, and is not intended for, children under 18, and we do not knowingly collect personal information from them. If you believe a child has provided us information, contact us and we will delete it.
We operate from the United States. If you use the App from outside the U.S., you understand that the limited information we receive is processed in the U.S.
We may update this Policy. We will post the updated version with a new date and, for material changes, provide additional notice. Continued use after changes take effect constitutes acceptance.
